Terms and Conditions

Please read the following information carefully! By signing and submitting the rental agreement form, you agree to the terms and conditions of this Agreement and proceed to complete your reservation. The remaining balance must also be received by the due date indicated on your reservation confirmation to secure your reservation in full.

Names of all guests

Renter will provide the names and e-mails of all guests at the time of booking.

Reservation

Reservations made within ninety (90) days of the arrival date must be paid in full via bank wire transfer or PayPal. Payment must be made in U.S. dollars. Mariposa Vacation Homes does not accept credit cards.

If the deposit is not paid in full within five (5) business days of submitting the reservation form, the reservation may be cancelled, thus making it null and void at managements sole discretion; management will have the right to rent the property to any other client.

If the remaining balance of your reservation is not paid in full within 5 business days of the due date (90 days prior to check-in), the reservation will be considered null and void and no refund will be issued. Management will have the right to rent the property to any other client.

Your reservation is not confirmed until we have received payment and you have received a formal written confirmation letter from Mariposa Vacation homes confirming the reservation.

The quoted rental amount is final. No additional discounts apply. Rates and conditions are subject to change at the sole discretion of Management. If the property is sold, you may receive a full refund.

CHECK-IN / CHECK-OUT

Check-in and check-out is conducted on-site at the house rented by our concierge. A copy of your itinerary including your time of arrival and departure flight is requested at the time of booking to coordinate your check-in/check-out.

Check-in:          02:00 PM

Check-out:        10:00 AM

CHECK-IN begins at 2:00PM and ends at 07:00PM on the date of your arrival as indicated on your reservation confirmation. In cases where guests arrive after check-in hours, a package with your house keys, alarm codes and property access codes will be left in a safe outside of the property to the left of the gate and you will be provided the code to the safe by our concierge. After-hours check-ins are only available if the reservation is paid in full and the rental agreement has been signed and returned. Due to the size and complexity of Mariposa Vacation Homes, our maids and maintenance staff work hard utilizing every last minute between 10:00AM and 2:00PM to ensure the property is clean and ready for occupancy by 2:00PM. Please do not arrive at the property prior to check-in unless otherwise arranged with Management or the concierge. In some circumstances, it may be necessary to delay check-in past 2:00PM to ensure the property is ready to reasonable standards. No refunds or discounts will be considered in the unlikely event of such delays.

CHECK-OUT time is no later than 10:00AM on your departure date. The concierge will meet the guests at their home to conduct the check-out. Guests are required to return the house keys while the concierge conducts a check for incidentals. All items such as beach chairs, beach bikes and any other rental items must be left at the home upon check-out. Fees may occur for failure to return these items to the property at check-out.

LATE CHECK-OUT

In the event that you require a late check-out, there is a late check-out fee per hour for each house and prior approval is required to ensure sufficient time for our staff to prepare the property for the next check-in especially on the same day of your check-out. If there is no prior written approval and the check-out is more than 1 hour late, a late fee will be charged at managements sole discretion. Casa Yin Yang ($250/hour), Casa Monarca ($250/hour), Casa Morpho ($100/hour).

Cancellations

In the case of a cancellation, we require at least 90 days prior written notice from date of check-in to accredit the amount you deposited less 20% administration fee per beach house based on the full rental amount. In the case of a cancellation less between 45 and 90 days prior to check-in, you will be accredited 50% the amount you deposited per beach house. In case of a cancellation less than 45 days prior to check-in all deposited funds will be forfeited. In the case of a ‘no-show’, the entire deposit will be forfeited and reservation will be cancelled with no refund option.

Security Deposit

Please note that a security deposit is required for each beach home rental ($1,000 Casa Morpho / $2,000 Casa Monarca & Casa Yin Yang). Security deposits can be made either via wire transfer with the reservation or cash to the concierge at the time of check-in. Security deposit will be returned when the rental unit is checked for damages upon check-out. Clients are responsible for all damages including legal fees in the case of damage to the property.

Maximum Occupancy

Guests are responsible for understanding and respecting the maximum occupancy limits of the home rented. Occupancy limits are listed on each home and reservation confirmation. Additional guests above the maximum occupancy of each home should be communicated with reservations and/or sales prior to booking. Any additional overnight guests not included in the rental agreement form will incur a fee of up to $100/person/night.

Casa Yin Yang:   8 guests maximum

Casa Monarca:  8 guests maximum

Casa Morpho:   4 guests maximum

Parties

The property is restricted to family and group rentals only. Any activity that hosts number of guests beyond the number of registered guests in the rental agreement form constitutes an event. All events and activities including non-profit events and pre and post wedding parties, dinners etc. in any home require prior written approval. Event fees with prior approval start at $250 per event. Fees may be waived at management’s sole discretion. Size of the group and other details will be considered in evaluating the cost of each event. Please inquire for more information and pricing. In the case of any event being held without prior written approval, a minimum event fee of $1,000 will be charged.

Pets
Pets are not allowed on the property.

Smoking

All of our homes are non-smoking. There is no smoking allowed inside any of the homes. Any additional cleaning required due to necessity of removing the smoke odor will be charged at the expense of the renter with a minimum change of $500.00. Smoking is only permitted outdoors, cigarette butts are to be disposed of properly in ashtrays provided and not thrown on the property grounds.

Subletting

No subletting allowed.

Cleaning and Maintenance

All homes are cleaned thoroughly prior to your arrival and daily during your stay. The pools in all three (3) homes are also cleaned on a daily basis. Should you require additional cleaning, this may be arranged at an additional cost of $20/hour/housekeeper. Please confirm in writing no less than 7 days prior to check-in to allow us time to coordinate with our staff. All staff and/or housekeeping services must be contracted through Mariposa Vacation Homes. We are not responsible for any third party providers not contracted through Mariposa Vacation Homes, renter is solely responsible and liable for all actions of outside third party providers.

Property Access for MVH Guests Only

Access codes to the main gate and beach access is for Mariposa Vacation Homes (MVH) guests only. The beach access code is specifically for guests of Casa Monarca and Casa Morpho. For your security, please refrain from providing the beach access code to anyone. Should you provide the code to any non-MVH guests, the code will be changed once and you will be provided with the new code. Should the code be given a second time to an outside party, the code will be changed and you will not be provided with the new code resulting in the loss of your rights to access the beach within the property and may enter only through the main entrance gate and the public access on the side of the property. The property is for registered guests ONLY. We reserve the right to admission.

Third Party Services

For your protection, all third party services including tours, ground transportation, chef services, massages, surf lessons, babysitters etc., should be contracted through our concierge and paid in advance. We strictly prohibit third party service providers of any kind on the premises of the property without the prior notice to management (at least 7 days).

Equipment

Please note that the bikes, beach chairs, towels, beach towels and other items provided are not included in the rental but are provided as a courtesy at no additional cost. These items are for the exclusive use of MVH guests. Should you choose to lend out, misuse or damage any of these items, there will be a charge of $20 per item per day and/or the replacement cost of each item plus shipping and handling fees where applicable. The use of any of these items may be revoked at any time at management’s sole discretion. Use of these items by third parties constitutes a violation of the rental policy.

Equipment Malfunction

In the event that any equipment fails, renter agrees that it is their responsibility to report all problems verbally to the staff, concierge and in writing to info@mvhcr.com as quickly as possible. We will make every effort to repair and resolve the issue but cannot guarantee when the problem and the speed of which the issue will be resolved.

Renter understands and agrees that NO refunds, discounts or transfers will be granted for the malfunction of any appliance or amenity, unexpected weather, mechanical breakdowns or other circumstances beyond our control. Further examples of circumstances include but are not limited to: breakdown of air conditioners; TV’s or other electronics or appliances that can malfunction, disruption of use or access to the beach due to nature or construction, presence of insects, disruption of utility services such as cable, internet, water, electricity; property not decorated to the taste of renter, presence of pests or bugs that do not render the property uninhabitable will not warrant cause for refunds, discounts or transfers.

Keys

Please take good care of the keys. We provide exterior safes so that you may safeguard the keys while you go to the beach. A minimum of $500 will be charged for lost keys.

Disclaimer

Renter agrees to hold owners, staff and management of Mariposa Vacation Homes harmless and release them from any and all liability for any and all incidents that may occur anywhere on the property including the house, grounds and swimming pools. Please be careful and use good judgement at all times. Please note that the nearest hospital is several hours away and we are not responsible for any robbery in and around the house or local surrounding areas. Mariposa Vacation Homes is entirely fenced, gated and well equipped with locks on all doors, windows, alarm system, built-in safes and nighttime security.

This agreement is non-transferable, non-assignable, non-endorsable nor subject to modification without the express written consent of management. No cash refunds.

Terms and conditions are subject to change at management’s sole discretion.

By submitting the rental agreement form, you have read, understand and agree with the rental policies of this agreement and by making payment, agree to abide by its terms and conditions.
